1. Shipping and Delivery
The Online Store ships goods worldwide (including EU countries, North America, Asia, etc.).
To receive the goods, the buyer has the following options: Omniva (courier and parcel machine), SmartPost (parcel machine), DPD (courier and parcel machine), DHL, UPS, Venipak, FedEx, and Nova Post.
The shipping costs are borne by the buyer, and the corresponding price information is displayed next to the shipping method during the checkout process.
Important: Orders shipped outside the European Union may be subject to import duties and taxes according to the laws of the destination country. These costs are the responsibility of the buyer and must be paid upon delivery.
Shipments within Estonia generally reach the destination within 2-5 working days. Shipments within Europe take 3-10 working days, and shipments to the rest of the world take 7-21 working days from the entry into force of the sales contract. For out-of-stock items, the delivery time is extended by 6-14 working days.
In exceptional cases, the Online Store has the right to deliver the goods within up to 45 calendar days (especially for remote destinations or due to customs procedures).
2. Right of Withdrawal
After receiving the order, the buyer (consumer) has the right to withdraw from the contract concluded in the Marmes Market store (hereinafter the Online Store) within 14 days without giving any reason.
The right of withdrawal does not apply if the buyer is a legal entity. Furthermore, the right of withdrawal does not apply to goods manufactured according to the buyer’s personal needs (custom orders), perishable goods, or goods in sealed packaging that are not suitable for return for health protection or hygiene reasons (e.g., cosmetics, underwear) if the packaging has been opened after delivery.
To exercise the 14-day right of return, the ordered goods must not be used in any way other than is necessary to verify the nature, characteristics, and functioning of the goods in the same way as is allowed for testing goods in a physical store.
If the goods have been used for purposes other than those necessary to verify the nature of the goods or show signs of use/wear, the Online Store has the right to reduce the refundable amount in proportion to the decrease in the value of the goods.
To return the goods, a withdrawal application must be submitted via the Online Store’s customer account or by sending an e-mail to info@marmesmarket.ee no later than 14 days after receiving the goods.
The costs of returning the goods are borne by the buyer, unless the reason for the return is that the product does not comply with the order (e.g., wrong or defective product).
Upon receipt of the returned goods, the Online Store shall immediately, but no later than 14 days after receiving the withdrawal application, refund all payments received from the buyer (excluding additional costs resulting from the buyer's choice of a delivery method other than the least expensive type of standard delivery offered by the Online Store).
The Online Store has the right to withdraw from the sales transaction if the price of the goods has been mistakenly marked significantly below the market price (obvious system error).
3. Right to File a Complaint and Dispute Resolution
The Online Store is liable for any non-compliance or defect of the goods sold to the buyer that exists at the time of delivery and which appears within two years of the delivery of the goods to the buyer. During the first year, it is presumed that the defect existed at the time of delivery.
Upon discovery of a defect, the buyer has the right to contact the Online Store within two months by e-mail at info@marmesmarket.ee. The Online Store will respond to the complaint within 15 days.
If a dispute between the parties cannot be resolved by agreement, the buyer has the right to contact the Consumer Protection and Technical Regulatory Authority (Consumer Disputes Committee) or use the EU Online Dispute Resolution (ODR) platform at http://europa.eu.
4. Processing of Personal Data
The Online Store uses the personal data entered by the buyer (name, phone number, address, e-mail, bank details) only for processing the order and shipping the goods to the buyer. The Online Store transfers personal data to transport service providers (Omniva, DPD, DHL, UPS, FedEx, etc.) in order to deliver the goods.
