1. General

The owner of the Marmes Market Online Store (hereinafter the Online Store) is Marmes OÜ (registry code 14001598), located at Narva mnt. 134-3, Raadi alev 60534 Tartumaa, Estonia. E-mail: info@marmesmarket.ee, tel: +372 58 558 559.

2. Validity of the Sales Contract, Product and Price Information

These terms of sale apply to the purchase of goods from the Online Store. Prices of the products sold in the Online Store are indicated next to the products in euros (€). A delivery fee will be added to the price.

The delivery fee depends on the buyer's location, the weight of the package, and the chosen shipping method. The delivery fee is displayed to the buyer in the shopping cart before confirming the order. Product information is provided in the Online Store directly next to the item.

3. Placing an Order and Payment Methods

To order goods, add the desired products to the shopping cart, fill in the required fields, and select a delivery method. The total cost is displayed on the screen, which can be paid securely via the following payment methods:

  • Bank payments: Swedbank, SEB, LHV, Luminor, Coop Pank, Citadele, PocoPay, N26, Revolut
  • Card payments: Visa, Mastercard
  • Mobile payments: Google Pay, Apple Pay
  • Buy now, pay later / Installments: Inbank solutions (slice, pay next month, installments)

Payments are mediated by Maksekeskus AS. Payment takes place in a secure environment outside the Online Store. The seller does not have access to the client's bank or card details. The contract enters into force upon the receipt of the total amount payable to the Online Store's bank account.

The owner of the Online Store is the controller of personal data and transfers the personal data necessary for making payments to the processor Maksekeskus AS.

If the ordered goods cannot be delivered (e.g., due to being out of stock), the buyer will be notified as soon as possible and the money paid (including delivery costs) will be refunded without delay, but no later than within 14 days.

4. Delivery

The Online Store ships goods worldwide. The buyer has the following delivery options: Omniva, SmartPost, DPD, DHL, UPS, Venipak, FedEx, and Nova Post.

Important: For shipments outside the European Union, import duties and taxes may apply according to the laws of the destination country. These costs are the responsibility of the buyer and must be paid upon receipt of the goods.

Shipments within Estonia generally reach the destination within 2-5 working days. International delivery can take 3-21 working days. For out-of-stock items, the delivery time is extended by 6-14 working days. In exceptional cases, the Online Store has the right to deliver the goods within up to 45 calendar days.

5. Right of Withdrawal

Individual buyers have the right to withdraw from the contract within 14 days of receiving the goods. The right of withdrawal does not apply to legal entities or to goods made to custom order, or goods that cannot be returned for health/hygiene reasons if the packaging has been opened.

To exercise the 14-day right of return, the goods must not be used in any other way than is necessary to verify the nature of the goods as allowed in a physical store. If the goods show signs of use or wear, the Online Store has the right to reduce the refund amount according to the decrease in value.

To return goods, an application must be submitted via the customer account or to info@marmesmarket.ee. Return costs are borne by the buyer, except if the product is defective or incorrect.

The Online Store will refund the money within 14 days of receiving the withdrawal application, but may withhold the refund until the goods are received back or proof of return is provided.

6. Right to File a Complaint

The Online Store is liable for defects appearing within two years of delivery. For individuals, it is presumed during the first year that the defect existed at the time of delivery. In case of a defect, the buyer has the right to demand repair, replacement, or a refund.

Complaints must be submitted within two months of discovering the defect to info@marmesmarket.ee or by phone at +372 58 558 559. The Online Store will respond in writing within 15 days.

7. Processing of Personal Data

The Online Store uses personal data only for processing the order and shipping the goods. Data is transferred to transport service providers (Omniva, DPD, DHL, etc.) and to Maksekeskus AS for payment processing.

The Online Store sends newsletters and offers only if the buyer has expressed a wish to receive them. The buyer can opt-out at any time by following the instructions in the e-mail.

8. Liability and Force Majeure

The Online Store is not liable for damages or delivery delays caused by circumstances beyond its control (force majeure). The Online Store is not liable for damages resulting from improper use of products or for indirect damages (e.g., loss of income).

9. Dispute Resolution

If the buyer has complaints regarding the Online Store, they must be sent to info@marmesmarket.ee. If the parties cannot reach an agreement, the buyer may contact the Consumer Disputes Committee.
